The State Council released a circular on June 15, giving instructions on implementing the 2021 guiding directory on comprehensive administrative law enforcement in the culture market. The directory will be printed and distributed by the Ministry of Culture and Tourism.
To push forward reform of the comprehensive administrative law enforcement in the culture market, overall plans to allocate administrative law enforcement functions and resources must be made, and overlapping law enforcement should be avoided. Thus the law can be enforced in a stringent, regulated, and fair manner.
The guiding directory mainly sorts out and regulates administrative punishments, mandatory matters, warnings, and fines in the culture market, and makes dynamic adjustments in accordance with the process.
Provinces, autonomous regions, and municipalities are allowed to supplement, refine, and improve the guiding directory.
Governance at the source of administrative punishment items and mandatory matters in the culture market should be strengthened. Any law enforcement items with no legitimate basis should be annulled. Law enforcement items to be retained or added should all accept legitimacy, reasonability and necessity reviews.
The circular calls on simplifying law-enforcement bureaucracy, pinning down the responsible person according to actual situations and regulation system, clarifying administrative law enforcement authority’s corresponding responsibilities, and improving the accountability mechanism.
A unified manual for comprehensive administrative law enforcement procedures and operations should be drafted, with items in this field incorporated in the regional comprehensive administrative law enforcement directing and dispatching platforms for unified management.
Efforts should be made to address the most frequently occurring problems and bring tangible benefits of the reform to market entities and the people.
The Ministry of Culture and Tourism should enhance guidance for subordinate regional departments and cement enforcement supervision.
