MOFCOM announcement No 14 of 2014 on expiration of anti-dumping measures against phthalic anhydride case

On August 30, 2009, the Ministry of Commerce of the People’s Republic of China (hereinafter referred to as the “Ministry of Commerce”) issued annual announcement No 56, deciding to continue to impose anti-dumping duties against imports of phthalic anhydride originated in ROK, Japan and India for another period of five years from August 31, 2009 till August 30, 2014.

In accordance with the provisions of Article 48 of the Regulations of the People’s Republic of China on Anti-dumping, the period for levy of the anti-dumping duties may be extended as appropriate if, as a result of the review, it is determined that the termination of the duties would be likely to lead to continuation or recurrence of dumping and injury.

As of the issuance of the Announcement, any natural person, legal person or relevant organization in or on behalf of China’s domestic industry may, apply for expiry review in written form to the Ministry of Commerce 60 days prior to the expiration of such anti-dumping measures. The application shall include an express statement on request for expiry review and sufficient evidence proving that the termination of the anti-dumping measures may cause the continuance or recurrence of dumping and injury.

If neither the natural person, legal person or relevant organization in or on behalf of China’s domestic industry applies for such review, nor the Ministry of Commerce actively initiates such expiry review before the expiration of such anti-dumping measures, the aforesaid anti-dumping measures will expire on August 30, 2014.
