The State Council on Nov 16 released a notice on the guidance catalog of comprehensive administrative law enforcement items for market supervision and regulation in 2022, which has been approved for use.
The catalog is an important document in implementing unified law enforcement requirements and clarifying the corresponding functions in market supervision and regulation, according to the notice.
It clarifies and regulates administrative punishments and administrative compulsive matters set in accordance with laws and administrative regulations in market supervision, and administrative punishments set within department stipulations. Adjustments will be made in accordance with procedures.
The notice calls for governance at the source for consolidating administrative punishments and compulsory matters to stabilize market expectations, and inspire the vitality of market entities. It said that administrative law enforcement matters without legal basis should be annulled, and for items that need to be added or maintained, investigation was necessary to verify their legality, reasonability, and necessity.
For items listed in the catalog, requirements are needed to distinguish between matters and management systems, clarify the major responsibility combining practical situations and ascertain the responsibility of handling illegal actions.
As required by the principles of transparency, openness, and high efficiency, and duty fulfillment, a unified stipulation of comprehensive administrative law enforcement proceedings for market supervision and regulation should be formulated. It will clarify the work procedures, duty requirements, time limits, code of conduct and more for handling administrative law enforcement matters, and eliminate any vague provisions.
In addition, the notice also called for focusing on items that concern market entities and people the most, putting more efforts into solving major problems that received the most complaints.
