MOFCOM announcement No 21 of 2014 on renaming of Rhodia Korea Co Ltd in anti-dumping case of adipic acid

On November 1, 2009, the Ministry of Commerce of the People’s Republic of China (hereinafter referred to as the “Ministry of Commerce”) issued Announcement No 78 of 2009, deciding to levy anti-dumping duties on imports of adipic acid originated in the US, the EU and South Korea. The anti-dumping duty rate applicable to Rhodia Polyamide Co Ltd was 5.9%. On June 23, 2011, the Ministry of Commerce issued Announcement No. 36 of 2011, deciding that Rhodia Korea Co Ltd should succeed to the rights and obligations of Rhodia Polyamide Co. Ltd. in the anti-dumping measures above.

On January 16, 2014, Solvay Chemicals Korea Co., Ltd. filed a petition to the Ministry of Commerce, requesting to succeed to the rights and obligations of Rhodia Korea Co Ltd in the anti-dumping measures against adipic acid, and submitted relevant evidentiary materials such as the resolutions of the general meetings of shareholders, registration documents, the articles of associations, the list of raw material suppliers, the list of major customers in China and relevant notarization and the certification documents from China’s Embassy in South Korea.

The Ministry of Commerce notified the domestic industry of adipic acid of the above-mentioned matters, which did not raise any objection with respect to the petition of Solvay Chemicals Korea Co., Ltd. within the specified time.

Upon examination, the existing evidentiary materials indicate that the renaming of Rhodia Korea Co., Ltd. to Solvay Chemicals Korea Co., Ltd. complies with relevant laws and regulations in South Korea. The operation management, manufacturing equipment, supply relation, sales channels and client base in connection with the product under investigation remain unchanged before and after such renaming.

Therefore, the Ministry of Commerce decides that:

1. Solvay Chemicals Korea Co., Ltd. succeeds to the rights and obligations of Rhodia Korea Co Ltd in the anti-dumping measures against adipic acid, and the applicable anti-dumping duty rate of the product under investigation that is exported to China is 5.9%.

2. The product under investigation that is exported to China in the name of Rhodia Korea Co Ltd shall be subject to the anti-dumping duty at a rate applicable to other South Korean companies in the anti-dumping measures against adipic acid, ie, 16.7%.

This Announcement shall take effect as of April 18, 2014.
