The State Council has released a circular to promote openness and fairness in administrative law enforcement by introducing pilot systems of information disclosure, full-process recording, and legal review of major law enforcement decisions.

According to the circular, pilot runs will be conducted in 32 regions and departments, including Tianjin, Hebei, Anhui, Gansu, the Ministry of Land and Resources, and Hohhot city.

Law enforcement entities in those regions and departments are asked to promptly and actively publish related information concerning law enforcement entities, personnel, responsibilities, limits of authority, and random check lists and procedures, at the official websites and service centers.

The circular called for law enforcement personnel to show qualification certifications in law enforcement, and local governments should set up a unified information sharing platform with related law enforcement entities.

Written, audio and video recordings are required in law enforcement, so that the law enforcement files are traceable and can be managed.

The circular also stressed legal reviews before making decisions on major law enforcement, and actions without reviews or failing to pass the review should not be implemented.

Innovation is encouraged in the pilot practices, which should be in line with China’s ongoing administrative law enforcement reform, according to the circular.
